PLEASE REVIEW THESE OFFICIAL RULES BEFORE ENTERING THE CONTEST.

ENTRY TO THE CONTEST IS FREE AND NO PAYMENT OR PURCHASE IS NECESSARY TO ENTER OR WIN. A PAYMENT OR PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

HOW TO ENTER:

1. Sign up at www.morty.org for a link to download the Green Screen Video and agree to these official rules.

2. REMIX the green screen video in your favorite video software by adding your own original content.

Binding Agreement

To enter the contest, you must agree to these Official Rules (the “Rules”). Read the following rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the contest constitutes agreement to these Rules. You may not submit an entry to the Contest if you are not eligible to receive the prizes described in the Rules. These Official Rules form a binding legal agreement between you and the Sponsors with respect to the Contest.


Overview

No purchase, payment, or donation of any kind is necessary to enter or win; a purchase, payment, or donation will not increase the chance of winning. By entering, the entrant agrees to be bound by these Official Rules and the decisions of the judges, which shall be final.

Contest Period

All entries received between 12:00 AM PST on 11/1/18 and 11:59 PM PST on 1/31/19 will be considered for the prize.


Eligibility

  1. The Contest is open to entrants anywhere in the world and will be evaluated according to the laws of the State of California, USA.
     

  2. To be eligible to participate in the Contest, entrants must be age 18 or older at the time the Contest Period begins, or have the signed permission of their custodial parent or legal guardian, who will then be responsible for adherence to these rules by the entrant.  A maximum of one Entrant per entry is allowed. Multiple persons who work on one video remix may submit only once under the name of one Entrant. If the Contest winner is under the age of majority in his or her country of residence, the contest prize may be awarded to custodial parent(s) or legal guardian(s) pursuant to the country’s applicable law.

Details

  1. After signing up and agreeing to these rules, Entrants will be given the opportunity to download a high resolution green screen video file of Children of the Light, performed by Morty Shallman and filmed by J, which also includes the high resolution music soundtrack.

  2. Qualified entrants shall create and upload music video “remixes” of the Children of the Light to Youtube, and then EMAIL a link to their video to morty@morty.org.

  3. This Contest is in no way sponsored, endorsed or administered by, or associated with YouTube. Any questions, comments or complaints regarding this Contest should be directed to Sponsors and not to YouTube.

  4. For the purposes of the contest, the definition of a “music video remix” is as follows: a video composition (i.e., the green screen video provided) which has been altered from its original state by adding, removing, and/or changing pieces of the composition, and is then synced to the music soundtrack provided.

  5. Entrants MAY alter the green screen video content provided, but MAY NOT alter the musical content. To be qualified for the contest, the finished product must be a full-length music video for the song “Children of the Light” in the song’s original written and recorded form. In other words, you may remix the video, but you MAY NOT remix or re-record the song for the purposes of this contest. That said, fan videos and cover version videos are encouraged, but they won’t be considered for this contest.

  6. Entries should be titled something along these lines:

    Morty Shallman - Children of the Light - Video Remix by (Your Name)

  7. No Submission will be considered by any entrant that fails to fill out the required forms and indicate their acceptance of these rules.

  8. Each entry may not be profane, offensive, defamatory or inappropriate as determined by the sponsors in the sponsor’s sole discretion. The sponsors reserve the right to disqualify any Submission they deem to be profane, offensive, defamatory, and/or inappropriate in the Sponsors’ sole discretion, and to demand a take down of the video from YouTube.
     

  9. The submission form must be filled out in English.

  10. The person uploading or submitting the Entry will be deemed the entrant (“Entrant”). The Entrant is the one person who owns the email address associated with the Submission. If any group (two or more persons) elects to collaborate on a Submission, they are required to designate one person as the Entrant who will be the agent of the group to enter the Contest, agree to the rules, and accept the prize(s). The Sponsors, its affiliates, its program partners, and any others involved in the development and/or execution of this Contest are not responsible for any disputes among collaborators related to prize collection.
     

  11. Each Entrant agrees not to submit any Entry that infringes upon any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligations, or otherwise violates applicable Japanese law. Entries violating this section of the rules may be disqualified.
     

  12. Each Entrant is limited to a total of one (1) submission.
     

  13. Each Submission must be the original work of the Entrant. It may not have been entered in previous contests or for previous awards. It may not have been published in any medium.
     

  14. Each Submission must not contain any copyrighted music works (either music or samples) other than the full-length, mixed and mastered version of Children of the Light provided by the Sponsors. Use of unauthorized music may result in disqualification of the Submission.
     

  15. By entering, each Entrant hereby releases and holds harmless the Sponsors, each of their subsidiaries and affiliates, and any others involved in the development and/or execution of this Contest, and the respective officers, directors, shareholders, agents, and employees of the same from any and all claims, demands, losses, promises, causes of action, and liabilities arising out of this Contest including travel.
     

  16. Submissions that do not comply in all material respects with the Official Rules or that otherwise contain prohibited or inappropriate content the sponsor’s sole discretion will be disqualified, not published, and/or not considered for prizes.
     

  17. By submitting an Entry, each Entrant agrees the that the sponsors and its designees may use, publish, adapt, modify, combine, or dispose of any Entry or Submission or elements there of any Entry or Submission online, in print, film, television, or any other media now or hereafter without additional compensation or notification to, or permission from, the Entrant, except as prohibited by law.
     

  18. The Sponsors are not responsible for lost, late or misdirected mail; printing errors; server unavailability; or computer or any other electronic or telecommunications malfunction.
     

  19. All Submissions received that are file corrupted, tampered with, or from ineligible entrants will be void. All Submissions become the property of the Sponsors.


Elimination

Any false information provided within the context of the contest by any participant concerning identity, mailing address, email address, ownership of right or non-compliance with these Official Rules, or the like, may result in the immediate elimination of the participant from the Contest. The sponsors further reserve the right to disqualify any entry that they believe infringes upon or violates the rights of any third party, otherwise does not comply with these Official Rules, or violates U.S. or California law.
 

Winners Selection

  1. Three (3) winners, First, Second and Third place, will be selected by the Sponsors. All decisions are final and binding.
     

The winners will be notified during the month of February, 2019 and announced shortly thereafter. Each Entrant agrees to be bound by the Official Rules, and the decisions of the judges are final in all matters relating to this Contest.

Prizes

  1. Three winners will be chosen and split a total cash prize as follows: First Place $250; Second Place $150; Third Place: $100.

  2. In addition to the cash prize, the winning videos will be designated “First, Second or Third Place Contest Winners” for Children of the Light, and will be eligible to receive a one-time payment equal to 25% of the net video streaming revenues, computed and paid in U.S. dollars, resulting from YouTube monetization only, for all views that occur within ONE YEAR from the announcement of the winner and the implementation of YouTube video monetization. There is no guarantee that any such revenues will accrue or be awarded.

  3. In order to receive the cash prizes, the winners agree to provide, immediately upon notification, a high-resolution copy of their music video remix to the sponsors for them to use, publish or post in any manner or medium they see fit, including posting on sponsors’ YouTube channel(s) with the exclusive right to monetize the video. The sponsors reserve the right to deny awarding the prize if the entrant fails to provide a high resolution copy in a timely manner.
     

  4. Odds of winning depend on the number of Entries received.
     

  5. The cash prizes will be paid out in U.S. Dollars. Winners are solely responsible for all taxes and/or conversion fees that may be incurred with acceptance of the cash prize and any subsequent share of YouTube monetization revenues that may accrue.
     

  6. The Winners are required to verify proper and legal picture identification within 30 days of notification of winning. The Winner may forfeit any and all winnings if verification cannot or has not been made within 30 days. Upon proper verification, cash winnings will be awarded by one of the following methods to be selected by the prize winner: bank transfer, PayPal transfer, or check. 


Winner Notification

  1. Winners will be notified by email and must provide photo identification to claim their prize. The Sponsors reserve the right to examine additional identification and may choose to accept or deny awarding the prize based on the identification presented.
     

  2. By participating in the Contest, each participant and the winners waive any and all claims of liability against The Sponsors and their respective employees and agents, for any personal injury or loss that may occur from the conduct of, or participation in, the Contest, or from the use of any prize.

  3. Each Entrant further agrees to release YouTube from any and all liability associated with this Contest or receipt or use of any prizes
     

  4. By claiming prize, the Winners authorize the use, without additional compensation, of his or her name(s) and/or aliases and municipality of residence for promotion and/or advertising purposes in any manner and in any medium (including, without limitation, radio broadcasts; newspapers and other publications; television or film releases; videotape; distribution over the Internet; and picture data storage) the Sponsors may deem appropriate.


Additional Rules

  1. The conduct of the Contest is governed by the applicable laws of The State of California, USA, which take precedence over any rule to the contrary herein. All claims relating in any manner to this Contest or to any Submission must be resolved in California and/or U.S. courts.

  2. The Sponsors and/or the Sponsors are not liable for any lost or stolen entries, prizes or contest information.
     

  3. By participating in the contest, participants agree to be bound by the decisions of The Sponsors’ personnel. The Sponsors reserve the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the contest, or obtained winner status using fraudulent means. The Sponsors will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the contest and their decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, intentional interference or any event beyond the control of The Sponsors, The Sponsors, reserves the right to terminate this Contest, or make such other decisions regarding the outcome as The Sponsors deems appropriate. All decisions will be made by The Sponsors and are final. The Sponsors may waive any of these rules in its sole discretion.
     

  4. The Sponsors reserve the right not to award any prizes if none of the entries received meet the stated contest criteria, to extend the deadline for receipt of entries and to make changes to these official rules as necessary to promote the success of the contest, in The Sponsors’ sole discretion.
     

  5. The Sponsors take no responsibility and assume no liability for any omissions, acts or damages that may result from the preparing of materials to submit to this Contest.


Intellectual Property Rights

  1. Green Screen Video Content: For the purposes of this contest only, the sponsors grant each entrant a free, non-exclusive license to “remix” the video elements and to post the results on YouTube for NON-COMMERCIAL purposes only. However, this license should not be construed as granting any ownership of the underlying video elements to any entrant, which shall remain the sole and exclusive property of The Sponsors, or in the underlying musical content (see #2 below).

  2. Musical Content: Both the Musical Composition (song) “Children of the Light” and the sound recording of the song provided in the source file are the exclusive intellectual property of Morty Shallman, © (p) 2018/Flying Bed Music (ASCAP). For the purposes of this contest only, Morty Shallman grants each entrant a free, non-exclusive license to synchronize the sound recording of Children of the Light to their video remixes, for NON-COMMERCIAL purposes only.

  3. By submitting any entry, entrants thereby grant to The Sponsors and their affiliates, subsidiaries, licensees and assigns, an irrevocable, perpetual and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish and otherwise make use of the submitted work (including the remix and all aspects and elements thereof) or other information in any and all media, whether now known or hereinafter created, throughout the world and for any purpose. In addition to other things, the rights granted to The Sponsors include, but are not limited to, the right to cut, censor, compress, edit, feature, and to otherwise alter or make use of the submitted work.
     

  4. By submitting an entry, entrants thereby represent and warrant that the submitted work or information does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and the entrants affirm they have the right to grant any and all rights and licenses granted to The Sponsors herein, including but not limited to, all necessary rights under copyright, free and clear of any claims or encumbrances.
     

  5. Entrants acknowledge and agree that The Sponsors shall have no obligation to post, display or otherwise make publicly available any work submitted by the entrant, and may, in their sole and unfettered discretion, remove, edit, modify or delete any work that the entrant submits.

Monetization

  1. Entries may not be monetized by Entrants during the contest period.

  2. Entries may be monetized by the Sponsors at any time, with no obligation to share revenues with Entrants.

  3. After the contest period, YouTube-qualified entrants may monetize their submissions if they first obtain permission from, and negotiate a fair revenue sharing deal with, The Sponsors.

Waiver of Liability and Agreement to Indemnify

By submitting any entry, each entrant, its, his, her or their heirs, successors and assigns (“entrant”) thereby releases, forever discharges and covenants not to make a claim against or sue The Sponsors and/or the Sponsors, and their parents, subsidiaries and affiliates, licensees, employees, officers, directors, representatives, successors and assigns (The Sponsors) of and from all manner of action or actions, cause or causes of action, at law or in equity, suits, claims, demands, liability, loss, cost or expense, of any nature whatsoever, known or unknown, fixed or contingent, which entrant may have or hereafter have against The Sponsors and/or the Sponsors by reason of any injuries or damages entrant may sustain, whether to entrant’s person, property, reputation, or otherwise, as a result of, incident to, or related in any way to the entry, the contest, or the use, incorporation or exploitation of the entry for any purpose described herein. Entrant waives and foregoes the right to seek injunctive relief against anyone relating in any way to the entry, the contest, or the use, incorporation, or exploitation of the materials for any purpose described herein. Entrant agrees to indemnify and hold harmless The Sponsors and the Sponsors from and against any liabilities, losses, claims, demands, costs (including, without limitation, reasonable attorneys' fees) and expenses arising in connection with any breach or alleged breach by me of any representation made in the entry or by virtue of submitting the entry. 


Privacy Policy

All personal information collected through the submission form at www.morty.org will be used solely for the purpose of the Contest. Emails obtained will also be added to the email newsletter list for Morty Shallman, which can be opted out of at any time by entrants by using the unsubscribe link at the bottom of the emails.

The Sponsors may be required to pass certain personal information on for the sole purpose of prize distribution. 

We are committed to the security of personal data that is submitted to us. All personal data collected relating to the Contest is handled solely by employees or contractors/vendors of the Sponsors.

The Sponsors will never publish, distribute, or sell to third parties any personal information collected during the Contest Period or at any other time prior to or after the Contest Period.
